Rental terms

It is extremely important to read the entire rental contract before you sign it. If you have any questions, please ask us before you sign.


The standard rental contracts that we supply are legally valid in Shanghai, according to China’s Property Rental Act regarding privately owned property.


The rental contract becomes valid and legally binding upon signature by the tenant (lessee) and landlord or real-estate agent (lessor). In the case of breach of contract, the lease may be terminated without notice by the lessor. Late or non-payment of rent will be charged interest, which is calculated daily at a rate of 1003% of the rental arrears. This interest payment should be paid to the lessor.


Please note: In Shanghai the apartment owner has the right to enter, vacate and withdraw private possession of the property without prior notice or without you being present.


To protect your position as a tenant, it is a good idea to set up a bank account with a Chinese bank for the duration of your stay in Shanghai and make all rent and related payments from there. Please note that you may need to provide proof of any payments made, so please retain all receipts regarding these transactions.


Rent and deposit

In Shanghai, the deposit for property rental shall be no more than three (3) months’ rent. Some contracts require two (2) months’ rent as a deposit, and some require three (3). Please refer to your individual contract for the terms of your specific property.


If an owner requires more than three months’ rent as a deposit, you have the right to dispute this and refuse to pay such a high deposit.


This deposit (2 or 3 months’ rent) should be paid in advance and is due upon completion of the contract.


SHS Service Fee

Shanghai Home Service charges 40% of the first month’s rent as their service fee. Please note this is due on contract completion.
