General terms and conditions
Shanghai Home Service rents and sales
1. Subject of the contract
The Shanghai Home Service company operates at the web address www.shanghaihomeservice.com, a real estate website through which it presents real estate properties in Shanghai.
Interested parties who share the property published on Shanghai Home Service with third parties are not entitled to a commission from the buyer or the tenant. Should the sharing to third parties by interested parties occur without the knowledge of Shanghai Home Service, Shanghai Home Service has the right to a compensation claim of the amount equal to the rent agreed in the contract for the property.
Shanghai Home Service solely offers property on its site. Only the advertiser and/or Shanghai Home Service are responsible for the contents of an advertisement/exposé. No other company or website may be mentioned by advertisers.
Shanghai Home Service is entitled to delete any information published on its website.
False information which is intentionally provided by advertisers about the advert’s subject will be corrected or removed from Shanghai Home Service’s website. The process for correcting or removing the adverts will be charged at 250 RMB (€20), including VAT.
2. Contract term
The term desired by the tenants is fixed in the contract and is binding until the end of this period. A refund of any remaining time due to premature termination of the contract is not possible.
The contract period begins with the day of the signing of the contract and shall automatically terminate upon expiry of the rental period laid down in the contract. A cancellation notice by the renter is not required.
3. Limitation of liability
In the case of adverts that have been provided on the site by external advertisers, content including photos, films, graphic representations and maps, is the responsibility of the advertiser. Any liability regarding copyright law will be the entire responsibility of the persons who provided the advert. Shanghai Home Service will not be liable in any case.
In the case of adverts that have been provided by Shanghai Home Service, Shanghai Home Service will be entirely responsible for their content.
For any damage which has been caused by breach of contract (e.g. subletting or misrepresentations to the rental agreement), Shanghai Home Service has the right to make the person responsible for said damage fully liable for all costs.
4. Removal of adverts
The advertiser agrees that Shanghai Home Service can adapt or edit any information that is incorrect or violates morality, or delete said information.
The company Shanghai Home Service assumes no responsibility for external links or other links in advertisements from advertisers.
4.2 The services and products of partner sites
The provider of partner services and products are solely responsible for said products and services. Shanghai Home Service takes over when the partner is not responsible for the products or services.
5. Payment terms
Payment for posting adverts on the real estate pages of Shanghai Home Service’s website is due with the publication of the advert. Shanghai Home Service is entitled to deactivate any adverts for which a payment is late and exceeds 7 days. Once payment has been received, the advert will once again be displayed. Deactivation does not release advertisers from the obligation of payment.
6. Other provisions
- Changes and additions to the contract must be in writing.
- The place of jurisdiction is Shanghai.
- In addition, the statutory provisions shall apply.
7. Data protection
Shanghai Home Service agrees to comply with data protection regulations, in particular the German Telemedia Act (TMG) and the Federal Data Protection Act (BDSG).
8. Transfer of customer data
Shanghai Home Service is committed to not providing any personal information to third parties without the express written permission of the persons concerned. Shanghai Home Service does not retain any data.
